U ponedeljak ujutru tako\u0111e su izvr\u0161ene fizi\u010dke provere u Dordrehtu.<\/strong>\u00a0<strong>ILT ovo izve\u0161tava na Tviteru.<\/strong><\/div>\n<div class=\"entry-content\">\n<blockquote><p>ILT proverava da li voza\u010di provode normalan nedeljni odmor od 45 sati u kabini kamiona. Ovo nije dozvoljeno po trenutnim pravilima. Poslodavac mora da ponudi odgovaraju\u0107i sme\u0161taj za spavanje.\u00a0Za nekoliko voza\u010da ovaj spoljni sme\u0161taj za spavanje nije bio raspore\u0111en. ILT je izvukao fine izve\u0161taje za ovo.\u00a0Evropska komisija je nedavno jo\u0161 jednom jasno omogu\u0107ila kako se nadgleda kampovanje u kabini.<\/p><\/blockquote>\n<\/div>\n<\/div>\n<div class=\"entry-date-author\"><strong>Ako voza\u010di provedu normalan sedmi\u010dni odmor od najmanje 45 sati u kabini, oni (i transportne kompanije) mogu biti ka\u017enjeni zbog toga. Ali postoji velika nesigurnost u vezi sa propisima i sprovo\u0111enjem oko ovog kampa u kabini. Evropska komisija poja\u0161njava ove propise.<\/strong><\/div>\n<\/div>\n<\/header>\n<div class=\"entry-content\">\n<p>Policija izri\u010de kaznu \u010dim na licu mjesta saznaju da je ovaj odmor u kabini u\u017eivan. Evropska komisija primila je mnogo pritu\u017ebi voza\u010da i kompanija jer nisu mogli da poka\u017eu hotelski vau\u010der tokom ex post inspekcije. Evropska komisija\u00a0<a href=\"https:\/\/transport.ec.europa.eu\/system\/files\/2022-02\/qa_mobipack_part_i_en.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">je dala dodatno poja\u0161njenje<\/a>\u00a0svog tuma\u010denja:<\/p>\n<ul>\n<li>Izvr\u0161ioci imaju pravo da pitaju voza\u010de gde su proveli normalan nedeljni odmor, ali ne mogu zahtevati od voza\u010da da dostave dokaz (kao \u0161to su hotelski ra\u010duni) o tome. Tako\u0111e ne mogu da izreknu nov\u010danu kaznu ako ovi dokazi nisu prikazani. Na dobrovoljnoj osnovi, voza\u010dima je dozvoljeno da to dostave.<\/li>\n<li>Izvr\u0161iocima je dozvoljeno da prate nedeljne odmore u poslednje \u010detiri nedelje (28 dana + trenutni dan). To je saop\u0161tila Evropska komisija u obrazlo\u017eenju ovih pravila iz Paketa mobilnosti.<\/strong><\/p>\n<\/div>\n<\/div>\n<\/header>\n<div class=\"entry-content\">\n<p><a href=\"https:\/\/cdn-trans.info\/uploads\/2023\/01\/90cf16034b211224fe185c19a5fe.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Komisija je saop\u0161tila da je<\/a>\u00a0saznala da su izvr\u0161ioci iz nekoliko dr\u017eava \u010dlanica EU zahtevali prate\u0107a dokumenta od voza\u010da kako bi dokazali da nisu kamp taksiji, ve\u0107 da su proveli u propisanom adekvatnom sme\u0161taju. Kao \u0161to je poznato, ovo tuma\u010denje pravila stvorilo je \u017eivu trgovinu hotelskim vau\u010derima u Evropi.<\/p>\n<blockquote><p>Komisija obja\u0161njava da \u010dlan 36 predvi\u0111a zapisne listove (u slu\u010daju analognog tahografa) i sve ru\u010dne registracije i otiske i voza\u010dku karticu (u slu\u010daju digitalnog tahografa). Me\u0111utim, dodaje se da &#8220;tijela dr\u017eava \u010dlanica ne mogu zahtijevati dokumente osim onih iz \u010dlanka 36. ove Uredbe.&#8221; Direktiva 4\/6\/EZ utvr\u0111uje obavezu saradnje izme\u0111u dr\u017eava \u010dlanica u pra\u0107enju uskla\u0111enosti sa periodima vo\u017enje i odmora.
