italijanskog Kasacionog suda (Ordinanza n. 5702\/2026) donosi va\u017ean presedan za sektor drumskog transporta<\/strong><\/p>\n<p data-start=\"314\" data-end=\"519\">U vremenu kada digitalni podaci sve vi\u0161e oblikuju poslovanje i pravne odnose u logistici, italijanski Kasacioni sud donio je odluku koja mo\u017ee imati dalekose\u017ene posljedice za sektor transporta \u0161irom Evrope.<\/p>\n<p data-start=\"521\" data-end=\"658\">Ordinansom broj 5702 od 12. marta 2026. godine potvr\u0111eno je da <strong data-start=\"584\" data-end=\"657\">podaci sa tahografa mogu biti validan dokaz prekovremenog rada voza\u010da<\/strong>.<\/p>\n<h2 data-section-id=\"6g0d2\" data-start=\"665\" data-end=\"712\"><span role=\"text\"><strong data-start=\"668\" data-end=\"712\">Tahograf vi\u0161e nije samo kontrolni ure\u0111aj<\/strong><\/span><\/h2>\n<p data-start=\"714\" data-end=\"858\">Sud je jasno definisao da tahograf nije samo tehni\u010dki instrument za pra\u0107enje vo\u017enje, ve\u0107 ima i <strong data-start=\"809\" data-end=\"857\">punu dokaznu snagu u radno-pravnim sporovima<\/strong>.<\/p>\n<p data-start=\"860\" data-end=\"901\">Podaci sa tahografa mogu se koristiti za:<\/p>\n<ul data-start=\"902\" data-end=\"1007\">\n<li data-section-id=\"1hb54pr\" data-start=\"902\" data-end=\"941\">dokazivanje stvarnog radnog vremena<\/li>\n<li data-section-id=\"iek7i1\" data-start=\"942\" data-end=\"976\">utvr\u0111ivanje prekovremenog rada<\/li>\n<li data-section-id=\"kfoo5u\" data-start=\"977\" data-end=\"1007\">obra\u010dun razlika u zaradama<\/li>\n<\/ul>\n<p data-start=\"1009\" data-end=\"1117\">Ova odluka potvr\u0111uje trend\u00a0<strong data-start=\"1042\" data-end=\"1117\">digitalni podaci postaju klju\u010dni element pravne sigurnosti u transportu<\/strong><\/p>\n<h2 data-section-id=\"19noqj2\" data-start=\"1124\" data-end=\"1176\"><span role=\"text\"><strong data-start=\"1127\" data-end=\"1176\">Slu\u010daj iz prakse: vi\u0161e od 10 sati rada dnevno<\/strong><\/span><\/h2>\n<p data-start=\"1178\" data-end=\"1297\">U konkretnom slu\u010daju, voza\u010d je koristio podatke sa tahografa kao dokaz da je radio du\u017ee od zakonom dozvoljenog vremena.<\/p>\n<p data-start=\"1299\" data-end=\"1408\">Sud je prihvatio ove podatke kao relevantan dokaz, iako su prethodne instance djelimi\u010dno osporavale zahtjeve.<\/p>\n<p data-start=\"1410\" data-end=\"1477\">Ovo jasno pokazuje\u00a0<strong data-start=\"1435\" data-end=\"1477\">tahograf postaje \u201csvjedok rada\u201d voza\u010da<\/strong><\/p>\n<h2 data-section-id=\"1dfc1uz\" data-start=\"1484\" data-end=\"1528\"><span role=\"text\"><strong data-start=\"1487\" data-end=\"1528\">Pravni okvir: dokazna snaga tahografa<\/strong><\/span><\/h2>\n<p data-start=\"1530\" data-end=\"1674\">Kasacioni sud je potvrdio da tahograf spada u tzv. <strong data-start=\"1581\" data-end=\"1607\">mehani\u010dke reprodukcije<\/strong> (prema \u010dlanu 2712 italijanskog gra\u0111anskog zakonika), \u0161to zna\u010di da:<\/p>\n<ul data-start=\"1676\" data-end=\"1810\">\n<li data-section-id=\"o7ieb2\" data-start=\"1676\" data-end=\"1713\">ima dokaznu vrijednost pred sudom<\/li>\n<li data-section-id=\"8hif1g\" data-start=\"1714\" data-end=\"1768\">mo\u017ee se koristiti za rekonstrukciju radnog vremena<\/li>\n<li data-section-id=\"byelo\" data-start=\"1769\" data-end=\"1810\">predstavlja objektivan izvor podataka<\/li>\n<\/ul>\n<h2 data-section-id=\"1b6s1hc\" data-start=\"1817\" data-end=\"1870\"><span role=\"text\"><strong data-start=\"1820\" data-end=\"1870\">Klju\u010dna poruka: osporavanje mora biti precizno<\/strong><\/span><\/h2>\n<p data-start=\"1872\" data-end=\"1943\">Jedan od najva\u017enijih aspekata odluke odnosi se na osporavanje podataka.<\/p>\n<p data-start=\"1945\" data-end=\"1962\">Sud jasno navodi:<\/p>\n<p data-start=\"1964\" data-end=\"2035\">\u2757 nije dovoljna op\u0161ta ili formalna primjedba<br data-start=\"2008\" data-end=\"2011\" \/>\u2757 osporavanje mora biti:<\/p>\n<ul data-start=\"2036\" data-end=\"2091\">\n<li data-section-id=\"1udwi3e\" data-start=\"2036\" data-end=\"2052\">pravovremeno<\/li>\n<li data-section-id=\"ryc3l7\" data-start=\"2053\" data-end=\"2066\">konkretno<\/li>\n<li data-section-id=\"nz6lae\" data-start=\"2067\" data-end=\"2091\">detaljno obrazlo\u017eeno<\/li>\n<\/ul>\n<p data-start=\"2093\" data-end=\"2151\">U suprotnom \u00a0podaci sa tahografa ostaju validan dokaz<\/p>\n<h2 data-section-id=\"1yhjyx1\" data-start=\"2158\" data-end=\"2217\"><span role=\"text\"><strong data-start=\"2161\" data-end=\"2217\">Teret dokazivanja \u2013 ali uz pomo\u0107 digitalnih podataka<\/strong><\/span><\/h2>\n<p data-start=\"2219\" data-end=\"2301\">Iako teret dokazivanja prekovremenog rada formalno snosi radnik, sud potvr\u0111uje da:<\/p>\n<p data-start=\"2303\" data-end=\"2366\">\ud83d\udc49 <strong data-start=\"2306\" data-end=\"2366\">tahograf mo\u017ee biti dovoljan dokaz da se taj teret ispuni<\/strong><\/p>\n<p data-start=\"2368\" data-end=\"2465\">To predstavlja zna\u010dajnu promjenu u praksi, jer se smanjuje prostor za subjektivne interpretacije.<\/p>\n<hr data-start=\"2467\" data-end=\"2470\" \/>\n<h2 data-section-id=\"9nx2u0\" data-start=\"2472\" data-end=\"2515\"><span role=\"text\"><strong data-start=\"2475\" data-end=\"2515\">Implikacije za transportne kompanije<\/strong><\/span><\/h2>\n<p data-start=\"2517\" data-end=\"2552\">Ova odluka ima direktne posljedice:<\/p>\n<h3 data-section-id=\"1prdkd\" data-start=\"2554\" data-end=\"2568\">Za voza\u010de:<\/h3>\n<ul data-start=\"2569\" data-end=\"2680\">\n<li data-section-id=\"8kilyf\" data-start=\"2682\" data-end=\"2699\">Za kompanije:<\/h3>\n<ul data-start=\"2700\" data-end=\"2844\">\n<li data-section-id=\"1qwunnc\" data-start=\"2700\" data-end=\"2737\">obavezna precizna evidencija rada<\/li>\n<li data-section-id=\"11oekb6\" data-start=\"2738\" data-end=\"2785\">potreba za sistemskim upravljanjem podacima<\/li>\n<li data-section-id=\"168fzhc\" data-start=\"2786\" data-end=\"2844\">pove\u0107an rizik od sporova ako evidencija nije uskla\u0111ena<\/li>\n<\/ul>\n<h2 data-section-id=\"1n3ql9b\" data-start=\"2851\" data-end=\"2900\"><span role=\"text\"><strong data-start=\"2854\" data-end=\"2900\">\u0160ira slika: digitalizacija kao pravni alat<\/strong><\/span><\/h2>\n<p data-start=\"2902\" data-end=\"2966\">Ova odluka nije izolovan slu\u010daj \u2013 ona potvr\u0111uje \u0161iri trend u EU:<\/p>\n<blockquote>\n<p data-start=\"2968\" data-end=\"3037\">\ud83d\udc49 <strong data-start=\"2971\" data-end=\"3037\">digitalizacija transporta prelazi iz operativne u pravnu sferu<\/strong><\/p>\n<\/blockquote>\n<p data-start=\"3039\" data-end=\"3139\">Tahograf, e-CMR, NCTS i drugi sistemi vi\u0161e nisu samo alati efikasnosti \u2014<br data-start=\"3111\" data-end=\"3114\" \/>postaju klju\u010dni elementi:<\/p>\n<ul data-start=\"3141\" data-end=\"3198\">\n<li data-section-id=\"z6j9aa\" data-start=\"3141\" data-end=\"3153\">kontrole<\/li>\n<li data-section-id=\"18o6zk1\" data-start=\"3154\" data-end=\"3174\">transparentnosti<\/li>\n<li data-section-id=\"1tk5kr5\" data-start=\"3175\"
